1.    General
1.1.   Welcome to Restucciart.com. The following are the rules or “Terms” that govern use of the Restucciart.com web site (“Site”) and the use of the services offered in this Site (“Services”).
1.2.   Restucciart.com is a business (“Restucciart”) which is owned and administered by Mr. Vincenzo Restuccia trading under the name Restucciart (“Restucciart”)
1.3.   Please check this page of the site periodically for any updates to these Terms. If You violate these Terms, Restucciart may terminate Your use of the Site, bar You from future use of the Site, cancel Your order, and/or take appropriate legal action against You.
1.4.   By requesting any Services including but not limited to purchasing of sunglasses/eyeglasses from the Site, You expressly agree to be bound by these Terms and to follow these Terms and all applicable laws, regulations and policies governing the Site and the Service.
1.5.   For the purpose of these Terms and without prejudice to specific definitions throughout these Terms;
1.5.1. “Customer” shall mean any User of Restucciart who purchases a Product.
1.5.2. “Restucciart”, “We”, “Us” shall mean the owner of this Site.
1.5.3. “Product” shall include but not be limited to sunglasses/eyeglasses produced by Restucciart sold from this Site.
1.5.4. “Site” shall mean https://www.restucciart.com
1.5.5. “Use” shall include but not be limited to visiting and/or viewing the Site, as well as making use of any Services from this Site.
1.5.6.  “You”, “User” shall mean, whoever visits the Site and/or requests Services offered on this Site.
1.6.   Restucciart shall have the right to change, amend, substitute, suspend or in any way alter these Terms at any time without any prior notice whatsoever, and such alterations shall be effective immediately upon posting on the Site.

2.    Permitted Use
2.1.   This Site shall only be used for what it is intended and any illegal and/or unauthorised Use of the Site shall lead to the legal proceedings being taken by Restucciart against the unlawful user. Furthermore, Restucciart reserves the right to restrain such unlawful user from visiting and/or making Use of the Site.

3.    Disclaimers
3.1.   Restucciart does not promise that the Site will be error-free, uninterrupted, nor that it will provide specific results from Use of the Site or any Content, search or link on it. The Site and its Content are delivered on an “as-is” and “as-available” basis. Restucciart cannot ensure that files You download from the Site will be free of viruses or contamination or destructive features. Restucciart disclaims all warranties, express or implied, including also any implied warranties of merchantability and fitness for a particular purpose.
3.2.   Restucciart makes no guarantee of any specific result from Use of this Site or its Services.
3.3.   Restucciart disclaims any and all liability for the acts, omissions and conduct of any third party users, Restucciart users, advertisers, promotes and/or sponsors on the Site, in connection with the Restucciart service or otherwise related to Your Use of the Site and/or the Restucciart service. Restucciart is not responsible for the products, services, actions or failure to act of any Venue, performer, promoter or other third party in connection with or referenced on the Site.

 4 Price
All prices shown on the website are indicated in Euro and are inclusive of IVA at 22% – Italia. Whilst we try to ensure that all the prices on our website are accurate, mispricing may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you within ten (10) days we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

Mispricing
Whilst we try to ensure that all the prices on our website are accurate, mispricing may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you within ten (10) days we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

Bulk Discounts
We do not offer additional discounts on large orders of a single item or on large orders of many individual items. Also, please note that the availability listings on our website are intended for single-item orders. ( Original vintage sunglasses e original vintage frame) .

Confirming Price
Items in your Shopping Cart will always reflect the most recent price displayed on the item’s product detail page. Please note that this price may differ from the price shown for the item when you first placed it in your cart. Placing an item in your cart does not reserve the price shown at that time. Therefore, it is possible that an item’s price may increase or decrease between the time you place it in your cart and the time you purchase it.
Some discounts are limited-time offers. The discount we are able to offer for any item is dependent upon its availability; our price will necessarily change if required.
Therefore, we cannot confirm the price of an item until we receive your confirmed order.

5.    Payments and Transaction Security Policy
5.1.   We do not keep any credit card details of our customers.

8.    No Association and Non-Affiliation
8.1.   Restucciart should not be associated to and/or affiliated to any other entity and/or person unless such a relationship in fact exists and is governed by an appropriate agreement.

9.    Unauthorised Use of the Site
9.1.   Illegal and/or unauthorized Use of the Site, including, but not limited to, unauthorised framing of or linking to the Site, or unauthorised use of any software on the site, will be investigated and appropriate legal action will be taken.

10. Violation of the Terms
10.1. You understand and agree that in Restucciart’s sole discretion, and without prior notice, Restucciart may terminate Your access to the Site, cancel Your orders or exercise any other remedy available and remove any unauthorised content, if Restucciart believes that the content has violated or is inconsistent with these Terms of Use violated the rights of Restucciart, the User or the law. You agree that monetary damages may not provide a sufficient remedy to Restucciart for violations of these Terms and You consent to injunctive or other equitable relief for such violations. Restucciart is not required to provide any refund to You if You are terminated as a User because You have violated these Terms of Use.

11. Product Description
11.1. We attempt to be as accurate as possible. However,we do not warrant that product descriptions or other content of this site is accurate,complete,reliable,current,or error-free. If a product offered by our website is nota s described, your sole remedy is to return it in an unused condition.

12. DELIVERY AND RETURN
12.1. We offer free shipping throughout Italy, including the islands. For all other EU countries it is possible to calculate the cost of shipping via the rate calculator that you will find on our site. All shipments depart from Italy, via express mail and traceable.
12.2. Deliveries in Italy usually take 2-3 working days from the date of purchase, depending on the area where you live.
12.3. Deliveries to other countries usually take:
• 4-5 days usually for the countries of the European Economic Area (EEA);
12.4. You can return the products within 10 days upon receipt and must be returned unused and in the same condition in which they are received.
12.5. You are responsible for the cost of returning products. Customers wishing to return products, should send an email to “support@restucciart.com”
12.7. The purchased products and rendered will not be refundable in cash, but may be replaced with another product of the same amount or higher. The newly selected product will be shipped upon receipt at our office, the returned product.

DELIVERY POLICY
The current state of stocks is approximate and some products may not be available. Your order may be delayed if the item is not available with our suppliers. We will inform you immediately.
We will try to deliver the goods within the expected time for delivery. If we are not able to do so, we reserve the right to deliver within 30 days from the next business day after you buy the product / s.
If we are unable to deliver the goods to you within 30 days from the next business day after you buy the product / s:
• will inform you by e-mail;
• we will make a further offer to you via e-mail;
• We do not make refunds under any circumstances, but you can select a new present product and available at the time on our shop
The goods will be sent to the address indicated by you at the time and confirmation of ‘order. If you are not at home, the delivery person will leave a note in your mailbox giving details on how to arrange a new delivery date. In cases of abuse considered our delivery service and collection, we reserve the right to impose reasonable charges for such services.
All deliveries must be signed and will be released only on presentation of ID card. Please make sure you keep the receipt enclosed with your goods for warranty purposes.

CANCELLATION, RETURN POLICY
All purchases are in general non-refundable but exchangeable for other products present and available at our store.

13. Limitation of Liability

13.1. In no event will Restucciart be liable to You for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits, even if Restucciart has been advised of the possibility of such damages.
13.2. In no event will Restucciart be held liable for inter alia skin irritation due to allergic reactions .
13.3 Restucciart is not responsible for any Products which are lost or stolen.
13.4. The maximum liability of Restucciart shall be capped at the total amount paid by the User/Customer for the Products bought from Restucciart for each specific transaction.

14. Indemnity
14.1. You agree to indemnify and hold Restucciart, its subsidiaries, affiliates, officers, agents and other partners and employees, harmless from any loss, liability, claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of Your Use of the Site, including also Your Use of the Site to provide a link to another site or to upload content or other information to the Site.

15. Governing Law and Jurisdiction

Thi is Italian website and is subject to the laws of the Republic of Italy and the application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. Every purchase you make shall be deemed performed in Italy. All disputes arising from the use of this website and or electronic contractual agreement shall be subject to the exclusive jurisdiction of the Courts of Justice of Italy.

The official language used in the contract is the English language, or Italian language.
